Credit Card Debts
Considering the critical economic problems swamping the globe, every American should be doing all that they can to minimize their financial obligations, and, for most of us, that starts with an erasure of the credit card debts that somehow seem to continue to pile up even as households cut budgets. Evaluating the causes behind the accumulation of credit card debts is as important as assessing the opportunities and resources available to the borrower looking to put an end to spiraling credit card debts and the accompanying bills. With credit card companies actively soliciting new debts from consumers at every step of the economic spectrum and a blithe societal avoidance of the systemic dependence upon high interest burdens, the shame of mounting credit card debts shouldn’t keep borrowers from examining both how the credit card debts first came to be a problem and the assorted means of liquidating the credit card debts once and for all.
Though many Americans instinctually turn to bankruptcy once their credit card debts have reached a certain level of difficulty, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 has increased the complexities of the paperwork (as well as the penalties, even criminal penalties, for sloppy or fraudulent documentation) and the potential for seizure of possession for auction. Furthermore, many filers for bankruptcy are formally excluded, in accordance with the latest governmental restrictions, from even qualifying for the Chapter 7 program which actually wipes clean the credit card debts if they’ve made sufficient income in the years prior to declaration. Worse yet, the limitations upon Chapter 7 bankruptcy protection legislated into the United States Bankruptcy Code will invalidate the legitimacy of most working Americans’ petitions regardless of the size of their credit card debts.
There are still other courses of actions intended to aid borrowers immersed in credit card debts but many of these involve risks that outweigh the supposed benefits. Consumer Credit Counseling has been shown to be little more than an extension of the credit card industry itself (which means that the companies have a vested interest in actually advising borrowers to continue their credit card debts) and were essentially established for the purpose of protecting the lenders through keeping the credit card accounts active, thereby maximizing the lucrative potential and preserving the significant profits incurred by compounded interest upon the credit card debts. Even more frustratingly, the Consumer Credit Counseling firms charge thousands of dollars to juggle the credit card debt balances so their clients may end up owing even more money as a result of the process.
In many superficial ways, the settlement negotiation strategy resembles Consumer Credit Counseling – and, to be certain, there will be significant costs to the clients through this program – but settlement negotiators have time and again been able to reduce the credit card debts of the consumers that are admitted to their program. Though trained settlement negotiation counselors are integral to the process of convincing lenders to abandon a percentage of the credit card debts, the borrowers are supposed to be equal partners in this struggle – repaying their bills as speedily as they could – and, since not all of the borrowers will be equally able to keep up their end of the bargain, some won't be able to employ settlement negotiation to eliminate their credit card debts. Still, considering the potential savings, all should definitely still try.
