Debt Relief

Debt Services

As the amount of consumer debt has exploded among all American households the past few years, the variety of the debt services has expanded as well. Generations past, the very concept of debt services – by which we mean debt services whose purpose should be to limit or eliminate the debts of ordinary borrowers – meant little more than the day to day business of the clerk and courthouse which aided the declaration of Chapter 7 bankruptcy. Wealthy borrowers, especially those dealing with investments and such, would invoke debt services to alleviate the need for federal protection (and the probable seizure of property), but those self same debt services are now offered to debtors of all classes who require professional specialists to guide honest and hard working borrowers toward the relief of mounting bills.

Much of the rise of debt services came about through the newly limited protection offered through bankruptcy services. In 2005, the Bankruptcy Abuse Prevention and Consumer Protection Act removed many aspects of the former guarantees and rendered an unfortunately significant portion of Americans newly unable to call upon Chapter 7 bankruptcy protection for assistance with their claims. Chapter 13 bankruptcy remains an option for all consumers that need employ this most difficult brand of debt services – the automatic stay of Chapter 13 bankruptcy protection could still be of some use to home owners wary of foreclosure or forbearance proceedings – but the average borrowers simply worrying over the formal dissolution of their ever increasing bills shall soon discover that the debt services Chapter 13 yet provides are far more injurious to the temporary financial survival and future credit opportunities than their benefit affords.

The debt services of Chapter 13 bankruptcy protection, limiting payments to creditors and minimizing the balances owed to unsecured lenders, are now dependent upon the average cost of living expenses which the Internal Revenue Service and the United States Census Bureau deem that the borrower's household size and state of residence requires. More troubling, the BAPCPA legislation thoroughly disables any potential leniency with which the bankruptcy court trustee may have seen fit to grant the borrowers petitioning for the Chapter 13 debt services. The amount of their applicable obligations – most unsecured loans aside from governmentally assigned burdens, though student loans are now separate from the practice and medical or hospital bills may soon be next – matters less than the amount of the heads of household's past gross income, and, because of this, most consumers attempting to follow the strategy laid down by the Chapter 13 debt services never reach full discharge of their unwanted red ink.

Still, the capitalist system loathes market vacancies, even debt services whose very nature seems to subvert the commercial order of things. The new breed of debt services features any number of different methods with which borrowers might temper their growing burdens, but there's a wide discrepancy to be seen within the various debt services. Consumer Credit Counseling companies tend to maintain connections to the lenders, for example, which creates obvious conflicts of interest while the consolidation equity loans masquerading as debt services extend the transferred debts to terms lasting for decades. In both cases, the debt services professionals underline the monthly savings to be found rather than attempting to actually help the borrowers rid themselves of the funds owed. Of all of the new debt services, settlement negotiation alone seems to have taken the place of Chapter 7 bankruptcy as the clear choice of consumers aching to be free of all monetary burdens, and, while this arm of the debt services industry shall have its own costs to bear, borrowers interested in a fresh start couldn't find a better place to start their research.
